TERMS & CONDITIONS

The following Terms and Conditions govern all trips booked with Bravo Luxury Travel, LLC (the “Company”) on or after September 15, 2022. Please read these Terms and Conditions carefully, as they set out yours and the Company’s respective rights and obligations.


1. For purposes of these Terms and Conditions, “you” and “your” shall mean all individuals
who have booked a trip with the Company and/or engaged the Company in travel planning
services (the “Services”).


2. By booking a trip with the Company, you agree that:

(a) You have read these Terms and Conditions and have the authority to be bound by all terms within them;

(b) You are of suitable age and physical health to participate in your booked trip, and can participate in all excursions; and,

(c) You accept all financial responsibility for payment of the booking.

3. The Company will not accept your booking without first receiving an executed copy of the
Company’s Liability Waiver Agreement, the terms of which are hereby incorporated herein
by reference, and no booking should be considered purchased or completed unless you
receive confirmation from the Company regarding, among other things, receipt of an
executed copy of the Company’s Liability Waiver Agreement. The Company reserves the
right to refuse or cancel your booking at its sole discretion.

 

4. PAYMENT

The Company requires fifty percent (50%) payment of your total booking cost upon the Company’s acceptance of your booking, as set forth in your itinerary. The remaining fifty percent (50%) shall be due forty-five (45) days prior to your departure date, or immediately, if departure date is within forty-five (45) days of booking. The Company reserves the right to cancel your booking in the event you fail to adhere to these payment terms.


5. Your itinerary is a road map for your trip, however, the Company may, in its sole discretion, modify the itinerary and make alternative travel arrangements in the event of an unanticipated change or cancellation. Hotel accommodations are subject to availability at the time of booking. The Company will endeavor to ensure that any replacement excursions, lodging, or travel arrangements are of equal value to the initial itinerary, however, that is not guaranteed.

 

You agree to adhere to the itinerary and be on time for all pick-ups and departures to and from itinerary locations, including all city departures. Failing to be on time for a scheduled departure may result in you being left behind, and you will be required to make alternative arrangements at your own expense.


6. By booking with the Company, you understand that traveling carries certain risks, and that some arrangements may involve strenuous physical activity or may be in areas where there can be additional risks of disease, injury, or death. By accepting the Services and participating in your trip, you acknowledge that you do so at your own risk.

 

7. FORCE MAJEURE

The Company may need to cancel all or a portion of your trip in the event of an unforeseen circumstance, such as an act of God. As further set forth in the Company’s Liability Waiver Agreement, the Company shall not be liable for any delays resulting from, without limitation, acts of God, acts of government, acts of war or civil unrest, strikes or other labor issues, public health emergencies, inclement weather, criminal, terrorist or threatened terrorist acts, or inclement weather. The Company will endeavor to find adequate replacement accommodations; however, the Company does not guarantee that such accommodations will be available or possible.


8. You are solely responsible for informing the Company of any known health conditions or
allergies in advance. As set forth in more detail in the Company’s Liability Waiver
Agreement, the Company is not liable for any injuries resulting from any known or
unknown medical conditions. In the event you become ill during your trip, if the Company
has appointed a Company representative to accompany you, that representative may take, in
its sole discretion, any steps necessary to contact your emergency contact or make any
arrangements to facilitate emergency medical care. You agree that the Company is not liable
for providing adequate medical care, nor will the Company be responsible for monitoring
any health care that you may need or receive.
9. Currency exchange rates fluctuate. Prices are subject to change based upon currency
exchange rate fluctuations, provided actual changes have occurred.
10. You are solely responsible for ensuring that you have all necessary passports, visas,
vaccination cards and/or other documents necessary for travel, as well as verifying that you
satisfy all exit and entry requirements for each travel destination set forth in the itinerary
provided to you by the Company. If you are unable to meet travel requirements and must
cancel your booking, you will be responsible for any cancellation fees pursuant to these
Terms and Conditions, and any additional incurred expenses.
11. The Company will not be responsible for the loss of any travel documents such as passports,
airline tickets, or other documents, nor will the Company be liable for any lost luggage or
personal belongings. In the event you lose your plane ticket, it is your responsibility to
obtain a replacement.
12. You are solely responsible for all incidentals, including, but not limited to, destruction of
hotel property, buses, cars, or other property, as well as all personal expenses such as WiFi,
telephone calls, or other additional accommodations not otherwise listed in your itinerary.
13. You agree to be subject to, and abide by, all local and international laws, regulations,
notices, and other governmental advisories for all destinations of your trip, including, but
not limited to, all laws relating to alcohol and recreational drug consumption. You agree
that, in the event you fail to abide by such laws, you may be sent home and will forfeit all
amounts paid for your trip. You are solely responsible for monitoring all applicable travel
advisories both before and during your trip.

14. You are solely responsible for ensuring that you adhere to all instructions and information
provided by the Company for your trip. If the Company sends a Company representative to
accompany you on your trip, you are required to follow all directions from that
representative. Inappropriate, unruly, or disruptive behavior will subject you to immediate
ejectment without a refund and at your sole expense.
15. The Company reserves the right to take photographs and videos of you throughout your trip,
and to use, re-use, publish, and republish your image, identity likeness, name, voice,
interview, statements, video clips and sound recordings, and/or photographic portraits or
pictures in which you may be included (“Images”), for promotional purposes. By booking a
trip with the Company, you acknowledge that the Company is the owner of the photographs
and videos, and you agree to allow your Images to be thereafter used by the Company. If
you prefer that your Images not be used, you must (1) notify the Company representative, if
any, who accompanied you on your trip upon the start of your trip; and, (2) notify the
Company, by email, no later than thirty (30) days following the end of the your trip of your
preference that the Company not use your Images. In the event you fail to comply with both
obligations, the Company will be permitted to use your Images and you will have been
determined to, individually and on behalf of any minor child travelling with you, have
granted unrestricted rights and permission for the Company to use your Images.
16. Cancellation Policy. Should you need to cancel your booking, you must provide the
Company with notice of your cancellation, in writing, within forty-five (45) days of your
departure. If you provide timely notice of cancellation, the Company will refund your
booking fee and payments, exclusive of air (both to and from your initial destination).
If you decide to leave the trip early due to loss of interest, sickness, or other personal
reasons, you are responsible for any additional costs incurred by interrupting your trip. This
includes, but is not limited to, your return flight and any other additional costs such as those
associated with transportation, accommodations, and meals. You will not be reimbursed for
any missed portions of the trip resulting from your early departure. You are solely
responsible for maintaining adequate travel insurance, including, but not limited to, carrying
any insurance policies that cover illness, injury, and other health issues that you may
encounter during your trip.
17. Reservation of Rights. The Company reserves the right, in its sole discretion, to change
these Terms and Conditions at any time. Updated versions of the Terms and Conditions will
be posted here on this website and are effective immediately on posting. Please check
frequently, especially before you use this website, and before booking, to see if these Terms
and Conditions have changed. Use of this website after any changes to these Terms and
Conditions constitutes your consent to any changes to same.
18. Arbitration; Choice of Law, Waiver of Jury Trial. THESE TERMS AND CONDITIONS
WILL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA

(WITHOUT REGARD TO ITS CONFLICTS OF LAWS PROVISIONS). EXCEPT
AS SET FORTH HEREIN, THE PARTIES WAIVE ALL RIGHTS TO HAVE
THEIR CLAIMS OR DEFENSES ARISING UNDER THESE TERMS AND
CONDITIONS HEARD OR DECIDED BY A JUDGE, JURY, OR IN A COURT
TRIAL, REGARDLESS OF THE BASIS OF THE CLAIMS OR THEORIES
THEREOF. ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF
OR RELATED TO THESE TERMS AND CONDITIONS OR THE SERVICES
PROVIDED BY THE COMPANY SHALL BE ADMINISTERED BY JAMS
UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES.
ANY AWARD OR FINDING WILL BE CONFIDENTIAL. THE ARBITRATION
WILL BE CONDUCTED BY A SINGLE ARBITRATOR THAT IS LISTED ON
THE ROSTER OF ARBITRATORS MAINTAINED BY JAMS. THE
ARBITRATION SHALL BE CONDUCTED IN THE STATE OF CALIFORNIA.
NOTWITHSTANDING THE FOREGOING, NOTHING CONTAINED HEREIN
SHALL PROHIBIT ANY PARTY FROM SEEKING AN INJUNCTION OR
EMERGENCY RELIEF IN A COURT OF COMPETENT JURISDICTION
(INCLUDING BUT NOT LIMITED TO FOR THE PURPOSES OF ENFORCING
THESE TERMS AND CONDITIONS). THE PARTIES FURTHER AGREE THAT
THE FEDERAL OR STATE COURTS LOCATED IN ____ COUNTY,
CALIFORNIA SHALL HAVE SOLE AND EXCLUSIVE JURISDICTION.
